RenovationUp and its subsidiaries and affiliates (hereinafter collectively referred to as the "Company," "we", "our", or "us") value our customers' privacy, which is why we are committed to being transparent about our privacy practices. This Privacy Notice describes the collection, use and disclosure of your information when you visit our websites or use our services (hereinafter "Services"). By accessing the Services, and/or providing your information, you are hereby agreeing to the RenovationUp Online Privacy Notice (hereafter, "Notice"), in addition to any applicable Terms of Service or Service Agreements. If you do not agree with this Notice, do not use our websites.

This Notice forms part of and should be read in conjunction with the Terms of Service.

As used in this Notice, the terms described below have the following definitions:

Personal Data means data that is processed by or on behalf of the Company that can be associated with or reasonably linked with an identified or identifiable person or household. Personal Data does not include information that does not identify a specific user.

Process or Processing means any method or way that we handle Personal Data or sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, and consultation, disclosure by transmission, disseminating or otherwise making available, alignment or combination, restriction, erasure or destruction of Personal Data.

1. Personal Data We Collect And Use

We collect Personal Data about you directly from you, automatically from your devices, and from third parties. Where we collect data about you from one of these sources, we have outlined the purposes for its collection and the Personal Data collected for that purpose below.

a. Personal Data You Provide

You may provide us with Personal Data directly through your interactions with us for the following purposes:

  • Communicate with You: To communicate with you about your use of our Services or updates regarding our Services, order confirmations and order updates, manage and maintain our business relationship with you, provide services according to our contractual agreement with you, respond to your inquiries, and provide customer service, we may collect your name and email address.
  • Processing Orders and Payments: When you place an order through our website for products or services, you provide information required to complete your transaction, including your name, phone number, mailing address, billing address, and financial information.
  • Marketing, Advertising and Promotions: To deliver relevant ads and to evaluate the effectiveness of our marketing and advertising campaigns, to send you newsletters, offers or other information about products and Services we offer, to contact you about our Services or information we think may be relevant to you, and to administer promotions, we may collect your name, email address, mailing address, and email and communication preferences.
  • Analyzing and Improving our Products and Services: To better understand how our customers and visitors use our Services and websites, to improve our websites, Services and business operations, to develop new products and services, and for research and analysis purposes, we may collect your name and email address.
  • Personalizing Content and Experiences: To tailor content we send or display on our websites and Services, to offer location-based customization and personalization, and to otherwise personalize your experiences, we may collect your name and email address.

b. Information Collected From Your Devices

We also collect information about how you use our Services from your device(s) or browser, for the following purposes:

  • Operate the Site: In order to operate the site, we may collect information automatically to ensure that the site functions properly and maintain the security of our site. We may collect your IP address, activity logs, certain device information and browser information. We may also derive location information from your IP address.
  • Communicate with You: When we communicate with you online, we may collect information automatically from your device or browser in order to operate the site, including IP address, device and browser information, and activity logs.
  • Analyzing and Improving our Products and Services: We may use your Personal Data for other business purposes, such as data analysis, identifying usage trends, and to evaluate and improve the websites, products, services and your experience, including: device and usage information, such as your IP address, browser and device characteristics, operating system, referring URLs, device name, location, information about how and when you use the websites and other technical information.
  • Personalizing Content and Experiences: To save you time when you visit our website by remembering your preferences, automatically fill in forms (such as your address), we may collect your IP address, device information, and browser information.
  • Protection: We may use your Personal Data as part of our efforts to keep the websites safe and secure and to protect others from harm or abuse, including: device and usage information, such as your IP address, browser characteristics, your computer's operating system, referring URLs, device name, information about how and when you use the websites and other technical information.

c. Personal Data Provided by Others

We may also collect certain Personal Data about you from third parties for the following business purposes:

  • Process Transactions: We use third party payment providers who are PCI-DSS compliant to process all transactions through our websites. When you make a purchase, our third party payment provider may share transaction information with us such as your name, email address, billing address, transaction information (i.e., amount of transaction, time of transaction, and transaction ID), payment method, phone number and other information in order for us to process your order.   • Communicate with You: We may use third parties to send you administrative information about products or services you have purchased. We may receive Personal Data about you from the third party, including name and email address.

d. Other Uses of Personal Data

RenovationUp may also use any of the Personal Data it collects or receives for the following business purposes:

  • To Develop Our Websites, Products and Services. We may use your Personal Data to further develop our existing websites, products and services, including artificial intelligence tools and features, or to develop new products and services.
  • To Protect The Websites, Us, and Others. We may use your Personal Data as part of our efforts to keep the websites safe and secure (for example, for fraud monitoring and prevention) and to protect others from harm or abuse.
  • To Enforce Our Terms, Conditions, and Policies. We may use your Personal Data to ensure you and others are complying with our terms, conditions and policies, including providing your information to law enforcement if we believe it is appropriate to do so and using your information in connection with legal proceedings brought by us or against us.
  • To Respond to Legal Requests and Comply with Applicable Law. If we receive a subpoena, discovery request, or other legal request, we may need to review and evaluate your Personal Data and potentially provide your Personal Data in response to the request. We may also need to use your Personal Data as needed to comply with applicable laws and regulations.
  • For Other Business Purposes. We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve the websites, products, services, and your experience.

2. Cookie Policy

This section describes how we use cookies and similar technologies to collect and store information when you visit our website. Like many companies, the Company uses certain technologies – cookies, web beacons, clear GIFs, tracking pixels, and similar technologies (collectively, "cookies") – to collect information when you interact with our website and email communications.

a. How do Cookies Work?

Our website uses first party cookies and third party cookies. The difference between first party cookies and third party cookies relates to the control of the party who serves the tracking technology. First party cookies are cookies that are specific to the website that created them. Their use enables us to operate an efficient service and to track the patterns of behavior of visitors to the website. Third party cookies, on the other hand, are placed on your device or served by a third party (i.e., not by the Company). b. How Does the Company Use Cookies

We use cookies consistent with this Notice. For example, a cookie may be used to determine your preferred language, maintain the security of our website and your account, measure website analytics, measure the effectiveness of our advertising and promotional communications, and gain information for marketing and advertising purposes, including by identifying the website from which a person was referred to the Company's site and to track other websites visited by an individual.

Information gathered through usage of a cookie is not linked to any direct personal identifiers (e.g., your name or e-mail address), unless you become a customer of the Company. Once you submit Personal Data on our websites (e.g., by signing up to receive information from us) we may link such Personal Data with data associated with your visit(s) to our websites.

Third-Party Analytics. Our websites use third-party web analytics services that use cookies, to help the websites analyze how users use the websites. The information that is collected about your use of the website will be de-identified or pseudonymized by the third-party analytics provider (Google) for the purpose of evaluating your use of the sites, compiling reports on website activity and providing other services relating to website activity and internet usage. The third-party analytics providers that the Company uses will not link your IP address with any other data held by them about you. Information collected by us through use of third-party analytics includes: number of visitors, referring URLs, and pages visited.

c. Disabling, Deleting, or Opting-Out of Cookies

If you do not want to have cookies placed on your device, many of them offer ways to opt-out. You may refuse the use of cookies by selecting the appropriate setting in our Cookie Preferences Center.

In addition, most web browsers allow at least some control of most cookies through browser settings. d. Do-Not Track Features

Many web browsers and some mobile operating systems and mobile applications include a "do-not-track" feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing do-not-track signals has been finalized and, as such, we do not currently respond to do not track browser signals or any other mechanism that automatically communicates your choice not to be tracked online. We will update this Notice if that changes in the future. These features are not an alternative to the settings you choose in our cookie banner.

3. Marketing Communications

You can opt out of receiving certain promotional communications from the Company at any time by following the instructions provided in e-mails to click on the unsubscribe link, or if available by changing your communication preferences by logging onto your account. Please note that your opt-out is limited to the e-mail address used and will not affect subsequent subscriptions. If you opt-out of only certain communications, other subscription communications may continue. Even if you opt-out of receiving promotional communications, the Company may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or the Company's ongoing business relations.

4. De-Identified and Aggregate Data

The Company may de-identify and aggregate data for its business purposes, including but not limited to, to improve the products and features of its Services, to maintain the security and integrity of its systems, for analytics, and other legitimate business purposes. Where we process De-identified Data, we commit to maintain and use the information in de-identified form and not attempt to reidentify the information, except where permitted by law. The Company may disclose De-identified Data to third parties who commit themselves to maintaining the De-identified Data in de-identified form and not attempt to re-identify the data for any business purpose.

5. How We Share Personal Data

We may share information about you to third parties as indicated below:

  • With other companies that provide services to us: We may share Personal Data with third-party service providers that perform services and functions at our direction and on our behalf. These third-party service providers may, for example, provide you with Services, assist in processing transactions, allow us to send you advertisements for our products and Services, provide customer support, send email marketing on our behalf, etc. We do not sell your information to these third-party service providers.
  • In aggregated, de-identified form to provide data to third parties for our benefit: We may provide aggregated statistical data to third-parties for our own analytics and business purposes. This data will not personally identify you or provide information about your specific use of the Sites or Services. We do not share your Personal Data with third parties for their marketing purposes without your consent.
  • With the other parties to transactions when you use the Services, such as payment processors and their service providers: We may share information about you with the other parties involved in processing your transactions. This includes payment processors and their service providers.
  • With other third parties for our business purposes or as permitted or required by law: We may share information about you with other parties for our business purposes or as permitted or required by law, including:
    • if we need to do so to comply with a law, legal process or regulations;
    • to law enforcement authorities or other government officials, or other third parties pursuant to a subpoena, a court order or other legal process or requirement applicable to us;
    • if we believe, in our sole discretion, that the disclosure of Personal Data is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity;

    • to protect our property, Services and legal rights;
    • in connection with payment and related services for purchases made using a Service;
    • to help assess and manage risk and prevent fraud against us, our users and fraud involving our websites or use of our Services, including fraud that occurs at or involves our business partners, strategic ventures, or other individuals and merchants;
    • to companies that we plan to merge with or be acquired by; and
    • to support our audit, compliance, and corporate governance functions.
  • With your consent: We also will share your Personal Data and other information with your consent or direction, including if you authorize an account communication with a third-party account or platform.
  • Affiliates and Subsidiaries: We may share your Personal Data with our different affiliates and subsidiaries. If we share your information, we will share only the information that is necessary and we will take reasonable steps to make sure that third parties take prudent steps to protect your information.
  • Marketing: We may share your Personal Data to deliver marketing communications to you. Absent your consent (which may be by means of opt-in, or a third-party interaction described in the next bullet point), however, the Company will not share your Personal Data with third parties, other than Affiliates, for their own direct marketing purposes, except in connection with changes in business structure or ownership (defined below).
  • Compliance with Legal Obligations: We may need to disclose certain information to auditors, government authorities, law enforcement, regulatory agencies, our legal counsel, third party litigants and their counsel, or other authorized individuals in order to comply with laws that apply to us, or other legal obligations such as contractual requirements.
  • Changes in Business Structure/Ownership: We may disclose or transfer your Personal Data to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Company's business, assets, or ownership interest (including any bankruptcy or similar proceedings).

We do not sell any individual's Personal Data, nor do we share that Personal Data with third parties for those parties' commercial use.

6. California Rights (Shine the Light Notice)

California residents have the following additional rights regarding disclosure of your Personal Data to third parties for their own direct marketing purposes:

We provide California residents with the option to opt-in to sharing of "Personal Data" as defined by California's "Shine the Light" law with third parties, other than with our affiliates, for such third parties' own direct marketing purposes. We do not share Personal Data with non-Affiliate third parties for their direct marketing purposes absent your consent. If you are a California resident, you may request information about our compliance with the Shine the Light law and/or withdraw previously given consent to sharing with non-Affiliate third parties for their direct marketing purposes by contacting using the methods in the "Contact Us" section below. Requests must include "California Marketing Privacy Rights Request" in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the provided e-mail address or mailing address.

7. Children's Privacy

Our Services are not intended for use by anyone under the age of sixteen (16). We do not knowingly collect any Personal Data concerning or from children under the age of 16, except when consent is provided by a parent or guardian. If we learn that we have collected Personal Data from a child under 16 without parental consent, we will take steps to delete the information as soon as possible. We recommend that parents or legal guardians be involved in the online activities of their children in order to prevent the collection of their Personal Data without parental consent. If you believe that we have inadvertently collected Personal Data about your child, please contact us at requests@renovationup.com and we will promptly delete or de-identify this information.

8. Data Retention

We will only retain your Personal Data for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements. After the retention period has expired, we will delete your Personal Data.

9. How We Protect Your Personal Data

We strive to take appropriate security measures to help safeguard your Personal Data from unauthorized access and disclosure. For example, only authorized employees are allowed to access Personal Data, and they may only access it for permitted business functions. We maintain technical, physical, and administrative security measures designed to provide reasonable protection for your Personal Data against loss, misuse, unauthorized access, disclosure, and alteration. The security measures include firewalls, data encryption, access controls to our data centers, and information access authorization controls.

While we are dedicated to securing our systems and Services, we cannot guarantee that loss, misuse, or alteration will never occur, we use reasonable efforts to prevent it. Please keep in mind that no method of storage or transmission over the Internet is completely secure, so your use of our services and provision of information to us is at your own risk.

You are not responsible for securing and maintaining the privacy of your password(s) and Account/profile information and verifying that the Personal Data we maintain about you is accurate and current. We are not responsible for protecting any Personal Data that we share with a third-party based on an account communication that you have authorized.

10. Changes To This Notice

We reserve the right to change this Notice from time to time. The updated version will be indicated by the "Last Updated" date and the updated version will be effective as soon as it is accessible. If we make any material changes to the Notice, we will notify you by reasonable means, which may be by email or posting a notice of the changes on our website prior to the changes becoming effective. The collection, use, and disclosure of your Personal Data by us will be governed by the version of this Notice in effect at that time. New versions of this Notice will be posted on this page of our website. We encourage you to check the Notice from time to time. Your continued use of the websites will signify that you consent to the collection, use, and disclosure of your Personal Data in accordance with the changed Notice.
